New law prohibits cell phone use while driving
Starting August 28, 2023, Missouri drivers will be prohibited from holding their cell phones while driving. The new law, Senate Bill 398, makes it illegal to physically hold or support a cell phone with any part of your body while operating a motor vehicle. This includes texting, talking, scrolling, or using any other app.
There are a few exceptions to the new law. Drivers will still be allowed to use hands-free features, such as voice-to-text, Bluetooth, or speakerphone. They will also be allowed to use their phones to make emergency calls or to report a crime.
Violation of the new law will result in a fine of up to $200 for a first offense, $300 for a second offense, and $500 for a third or subsequent offense. Drivers under the age of 21 will face an additional fine of $250 for a first offense.
The new law is designed to reduce distracted driving accidents. According to the Missouri Department of Transportation, distracted driving was a factor in 380 fatal crashes in Missouri between 2017 and 2021.
“This new law is a common-sense measure that will help keep Missouri roads safe,” said Governor Mike Parson. “I urge all drivers to put their phones away and focus on the road.”
If you are caught violating the new law, you may be able to avoid a fine by completing a distracted driving awareness course. These courses are offered by many driving schools and organizations.
